Please note that credit card payments for DC Pedicab are collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland (“TREKKSOFT”). Therefore, TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement for the payment of this booking. The domain where you enter and process your payment is owned and operated by TREKKSOFT.

TERMS AND CONDITIONS

1 - RESERVATIONS - It is your responsibility to meet your DC Pedicab chauffeur at the correct time and location for scheduled departure. In the event you miss a planned departure time, any extra waiting time costs incurred will be paid by you and included in your billable hourly services fee.  Guests who miss a departure time due to a delay or cancelation of incoming or connecting multi-modal transportation, traffic delays, clocks or watches set incorrectly, or even general tardiness  would be offered the option of applying the prepaid tour or ride fee toward rescheduling the reservation to another available time, less a $20 change fee.  You would not be entitled to a refund in this circumstance.  Please make a dilligent good faith effort to notify us of your delayed arrival by sending us a text message to (202)345-8065, or by calling us at the same telephone number.  If you are arriving to the tour/ride departurre location more than fifteen (15) minutes after your scheduled departure time, and you do not contact us within those fifteen (15) minutes by text message to (202)689-5511, or by telephone call, to notify us of your delayed arrival, your reservation will be cancelled, and no refund will be offered.

2 - RESCHEDULING A RESERVATION - If you need to reschedule your reserved ride or prepaid tour reservation on the day of your reservation, please try to give us at least two hours notice before your appointment by sending us a detailed text message to (202)345-8065.  We would then offer to credit your prepaid tour/ride fee or deposit toward a future ride, less a $20 change fee.  We would do our best to accommodate your change in plans by rescheduling your reservation to another available time either that day, or another day. Due to the nature of the services provided, and the unpredictability of traffic conditions here, DC Pedicab will not be liable if any tour or ride service departs later than, or arrives later, or earlier than the specified or scheduled times, even if as a result you might miss a connecting transportation service, dining reservations, a theater or concert performance, or other appintments.

3 - CANCELLATIONS, REFUNDS, WEATHER ISSUES - We will give a full refund of deposits or prepaid tour fees for cancellation requests made by you via e-mail at least 24 hours before the start time of your event, for any reason whatsoever.  Please send us an e-mail using the "contact us" form on this website.  Within 24 hours of the start time of your tour, ride or event, there is only a 50% refund available, and only if you decide to cancel due to a 50% or greater chance of forecasted (http://Weather.com) precipitation such as rain, sleet, or snow. If our pedicabs and chauffeurs have already been deployed to the event by the time you cancel due to weather, which is two hours prior to event, there would be no refunds available.  We have rain and shade canopies and umbrellas, and blankets, on most of our pedicabs available by request while inventory lasts.  We can fulfil our advance reservations rain or shine, in the heat of the sun or the cold of a DC winter!  We raise this issue as isolated rain showers, even thunder showers, are not uncommon here during the spring, summer and fall.  In the summer the weather can sometimes be hot, humid and sunny.  In the winter, the wether here can sometimes be cold and blustery.  For some, this is a great reason to seek the shelter that a pedicab offers.  For others, this is a total "deal-breaker” and we offer a responsive cancellation policy as outlined above. DC Pedicab may not be held responsible for any delay, deviation of route, or slower speed of travel due to weather conditions.   DC Pedicab reserves the right to cancel/change tours due to critical and unforseen circumstances up to, but not less than 24 hours in advance. In the event a tour is canceled/changed, you will be notified via email or text message, or by telephone call, or voicemail message. In the event of an unforseen cancellation by DC Pedicab you will receive a full refund for the amount paid.  Any discounted fares, promotion fares, sale fares, gift certificates and package deals are non-transferable and non-refundable and have no cash value.  No refunds will be made in respect of any unused portion of a reserved ride or tour voucher or for a partially completed trip.

4 - TOUR SERVICES FEE BALANCE AND FORMS OF PAYMENT ACCEPTED -All tour vouchers and reserved ride vouchers purchased on this website are deemed to be payment tendered in exchange for hiring your DC Pedicab Chauffeur to be avialable to your exclusive service for a given block of time, for example, 60 minutes, 45 minutes, 30 minutes, and for a set number of passengers.  Any engagment of their services beyond that block of time, or extra passengers you expect to enjoy the tour/ride will incur an overage services fee balance at the hourly per person rate that corresponds to the time of year (summer, winter, etc.) you are hiring us.  For example, if you hire us for one hour by purchasing a voucher here on this website for one hour, and then, once on the pedicab you decide to tour with us (which includes as many stops as you wish to make to enter the memorials or take photos) beyond one hour, you will need to pay your balance directly to the chauffeur at the end of the tour or ride.  It is your responsibility to keep track of the time you wish to spend enjoying a tour or ride with us.  You should prepare to pay this balance in cash directly to your chauffeur although other forms of payment may be accepted at the sole discretion of your chauffeur.  He or she will be happy to make a stop at an ATM at some point during the tour for your convenience.  Please note well, we do not offer "flat rate" or "itinerary based" tours with untimed or unlimiuted stops.  If you expect to be travelling with extra passengers you might "bump into" whether small children, friends, family members, grandparents, etc., please take note of our per person/seat pricing poilcies and the extra charges that would apply.  A tour you hire for two persons, is a tour for two persons, not for three or four persons.  One (1) small child (age 6 or under please) that can sit on the lap of a paying passenger (parent or adult guardian) may ride at no extra charge.  We can transport up to four children per pedicab.  All children age 7 or over need to purchase a seat voucher.  If you have any specfic questions on seating arrangments, please call us at (202)345-8065.  Please note well, these tour fees do not include an optional gratuity (payable directly to the tour guide) for good service which is usual and customary in the hospitality sector in the United States

5 - FORCE MAJEURE - Although unlikely, tours and reserved rides may be canceled/changed/delayed by DC Pedicab due to an array of unforeseen emergencies that could occur whjere we operate in Washington, DC. For purposes of this Agreement, Force Majeure shall mean a cause or event that is not reasonably foreseeable or otherwise caused by or under the control of DC Pedicab, including acts of God, fires, floods, presidential motorcade routes or VIP motorcade routes, street closures, explosions, terrorist attacks, unforseen closure of federal facilities for national security reasons, other national security reasons, assination attempts, wars, riots, or other civil insurrection, sabotage, hurricanes, tornadoes, tropical storms, dangerous thunderstorms, vandalism of equipment or facilities, mechanical emergencies or breakdown, accident, restraint of government, governmental acts, injunctions, labor strikes, other than those of DC Pedicab or its suppliers, that prevent DC Pedicab, from furnishing the materials or equipment, and other like events that are beyond the reasonable anticipation and control of DC Pedicab, despite DC Pedicab's reasonable efforts to prevent, avoid, delay, or mitigate the effect of such acts, events or occurrences, and which events or the effects thereof are not attributable to DC Pedicab's failure to perform its obligations under this Agreement. 

6 - PERSONAL BELONGINGS - DC Pedicab may not be held responsible for your personal belongings. It is your responsibility to look after your belongings yourself.  If you are under the belief that you left something in one of our cabs, text us or call us at (202)345-8065 at any hour of the day or night and at our earliest convenience, we will check to see if anything has been turned in at our lost and found, or we can check with your chauffeur if you remember her/his name or can describe him or her.  Please allow us at least one business day to reply to you, especially if you are contacting us in the evening, or late at night.  You might also contact any bars, restaurants, nightclubs, parties, stores and shops, museums, or other attractions you have visited during your busy day/night.  DC Pedicab cannot be held responsible for loss, theft or damage to any of your personal belongings, regardless of the circumstances.

1.5 - DISABILITY ASSISTANCE AND ACCOMMODATIONS - The services offered by DC Pedicab are travel packages consisting of sightseeing tours and entertainment-based transportation rides.  DC Pedicab Chauffeurs cannot promise to offer constant special attention or qulified medical or nursing assistance should you have any physical disability requiring such qulfied attention or assistance.  We cannot leave our pedicabs left unattended in most areas, even if only for a few minutes.  Many of our pedicabs have steps and handrails to make for even easier boarding and alighting, and we can stop alongside curbs to facilitate this as well.  With advance notification, we can accomodate and secure crutches and walkers with appropriate fasteners.  We occasionally transport passengers with folding wheelchairs and can arrive to your tour/ride origin with a folding wheelchair for an additional fee.  When folded we can transport these wheelchairs on the flooorboard of the pedicabs.  Much like a car taxi, though, unfortunately, we cannot accomodate large electric wheelchairs, but we can recommend a qualified public para-transit service provider.  We can accommodate service animals on a harness or leash.  If you have a reimburseable medical/insurance/transportation expense situation, please notify us in advance so we can issue you an appropriate receipt.

7 - PHOTOGRAPHY - You agree that DC Pedicab may take photographs and films of you, or your likeness, while you are participating on a DC Pedicab ride or sightseeing tour. You agree that these images may be used for marketing purposes by DC Pedicab. These images may be used in, but are not limited to, brochures, websites, print media and promotional videos. These images may be used for publicity and advertising without DC Pedicab having obtaining further consent or payment for the use of images of you or your likeness.

8 - POLITICAL CONDITIONS - On your tour or ride in Washington, DC, the nation's captial, where we frequently operate in areas near sensitive federal facilities and presidential motorcade routes, you agree to comply with the public laws and regulations of the District of Columbia and the United States of America, including the directions and lawful orders of United States Secret Service agents and Uniformed Division Police Officers, United States Capitol Police Officers, United States Park Police Officers, National Park Service rangers, DC Metropolitan Police Department officers, DDOT Traffic Operations officers, or any other duly sworn law enforcement officials, who identify themselves as police officers, whether or not they are in uniform at the time or display a badge or shield.

9 - SAFETY AND ENJOYMENT - There may be times when the DC Pedicab Chauffeur must make a decision for the safety and/or the best interests of the tour group. It is a condition of booking that you comply with the authority and decisions of the DC Pedicab Chauffeur.  If you do not comply, or if in the opinion of the DC Pedicab Chauffeur you are not compatible with the general enjoyment of the group or the smooth operation of the tour, DC Pedicab reserves the right to refuse to allow you to continue with the ride or tour. You agree that DC Pedicab has the exclusive right dispel you from a ride or tour at anytime, without any claims or complaints by you against DC Pedicab. In such a case DC Pedicab will not be liable for any refund, compensation, or additional costs, or attorney's fees incurred by you.
